EU trade marks no longer cover Jersey

In a declaration dated March 2024, the government of Jersey has stated that EUTMs no longer cover Jersey, and that in fact they have not provided protection in Jersey since April 2009.

This means that if you or your clients were relying on an EUTM for protection in Jersey, then you will need to seek an alternative form of trade mark protection. Trade marks can be protected by re-registration in Jersey of a trade mark first obtained in the UK and this includes ‘comparable UK marks’ (clones).

Alternatively, international trade marks protected in the UK under the Madrid Protocol are automatically protected in Jersey without the need for re-registration. Note that EU designations of an international trade mark have never extended to Jersey.

For further information about protection in Jersey, please contact your usual trade mark attorney.
